The land of Elwick - 12d. a year to the prior of Durham's exchequer; 30s. a year to "Mensa Sancti Cuthberti de Insula", half at Martinmas and half at Pentecost, to be paid before the ninth hour, i.e. "prandium", in whole pennies, on pain of being doubled.
The 8 bondsmen of that vill - plough for 1 day with 4 ploughs at wheat-sowing and harrow for 1 day with 4 harrows, almost until vespers, receiving 1 white loaf of lesser weight and 1 servant's loaf with accompaniment between two, and drink for those ploughing; each reap with 1 man for 3 days at harvest, consecutively or not, at the discretion of the serjeant of Fenham, receiving 3 cobs and 5 herrings between two, and a stone of cheese between twenty as the bondsmen of Fenham; do suit at the prior's court at Fenwick; repair as necessary the mill-pond from "Ewesenburtre galfridi" to the sluice, and the lade from "Partenecruk" to "Langstadbrig"; each thresh for 1 day in Fenham grange against the prior of Durham's coming, receiving 3 cobs and 5 herrings or "gibbones" between two; pay 16 hens at Christmas, and 20 eggs each at Easter; uproot 60 turves of "helme" [? bent-grass] in Ross nook and carry it to the boat of "lewele"; pay an entry-fine for vacant bondlands to the prior of Holy Island; pay subsidy imposed by the prior of Durham on his men according to their means.
The 5 cottars - pay 5 hens at Christmas, and 10 eggs each at Easter; clear the mill-pond with the bondsmen.
The predecessors of the sisters [?] now summoned in Elwick - do suit at the prior of Holy Island's court, and if injuring said bondsmen or cottars attached and stand trial in that court.

(original does not survive) Instrument by Thomas de L'Abbay, notary public, recording that Margaret Fairfax, prioress, and 16 members of the convent of Nun Monkton, in chapter, exhibited an indentured lease dated 26 June 1392 with memorandum (recited, as preceding entry), sealed with an “oblong” seal of red wax with a device of the Blessed Virgin Mary seated, holding her son on her left arm, with the legend “Ave Maria gracia plena dominus tecum”, which they acknowledge to be their common seal; they stated that their former common seal, made of jet, which was used for an earlier agreement (i.e. of 1265), was subsequently broken and was replaced by the present one.

(original does not survive) Settlement of a dispute between Hugh Gobiun, knight, and R[ichard of Claxton], prior of Durham: grant by Hugh that he and his men of Tudhoe will cultivate and sow for the use of the prior certain parts of Spennymoor, viz. 20 acres in “Bradescrouc”, 7 acres between “Bradescrouc” and Meldrit's sheepfold, and 16 acres at the head of Middlestone, saving to Hugh and his men of Tudhoe common of pasture there after the removal of hay and grain; reciprocal grant by the prior that the stream of the eastern fishpond of Spennymoor, which issues from Hugh's mill at Tudhoe, shall revert to its old channel, and that Hugh and his men may gather marl from the prior's lands for 7 years, provided that they do no damage to crops or meadows.

Added in space (unidentified: copies, all later than this: 2.14.Spec.38, dupl; Loc.X:26}): {Grant, by Richard de Hoton, prior, and the convent of Durham to T[homas] of Herrington, knight, in return for his grant in free alms of the manor of Houghall, of confraternity for life, prayers by the monks at his death as for one of their number, and provision of two chaplains to celebrate masses for his soul in the chapels of Herrington and Harraton respectively, also two monks to celebrate likewise in Durham Cathedral at the altars of St John the Evangelist beneath the great cross (?) and St Cuthbert in the chapel of the nine altars (“in fronte ecclesie”) respectively; in the event of a cessation of these services for three or six months respectively the matter is to be referred to the jurisdiction of the official of the bishop of Durham or the official of the archdeacon of Durham or of Northumberland, who may compel performance on pain of 20s. to be paid to the bishop's almoner, one mark to be paid to each official, 20s. each to the sheriffs of Durham and Sadberge and £20 in aid to the Holy Land until the arrears of celebrations shall have been fulfilled doubly (?); Thomas may during his lifetime appoint the chaplain serving at Herrington; the manor of Houghall must be retained in perpetuity for the upkeep of these services; Thomas will be remembered daily in masses celebrated in the chapel of the Nine Altars.

It is shown by inquest that William Sherewynd holds 1 bovate in Hartburn by grant and feoffment of Robert of Caen, his ancestor, for a rent of ½ mark p.a. to the fabric of Pounteys Bridge and its custodian, and that William has been withholding this rent from William the reeve of Dinsdale, the custodian, for 3 years, to the damage of the fabric, valued at 10s. Decided that the bailiff shall distrain on William Sherewynd etc., and that Sherewynd shall attend the next court to show cause why the money should not be levied from his land.}

Settlement of a dispute between the prior and convent of Durham, appropriators of the church of St Oswald, and John Leg, executor of the testament of Alice, his late wife, a parishioner, concerning a horse to be given as a mortuary according to long established custom, and further between the prior and convent and John Leg with John Lewyn, William of Sheraton, William of Hull, Henry of Sherburn, John Barker (Barkear), Walter of Cocken, Thomas Herte, John Reed, Richard Smyth, John Milner (Milnere) of Elvet, Richard Webster (Webstere), William of Newburgh, John Raper, Thomas of Pittington, John Heryngear, Richard Gloofar, John Barker (Barkear), William of Burn, William son of Cuthbert, Gilbert Wright (Wryghte), John Gloofar, John of Cawood, Edward Tailor (Taillour), John Chaloner, John Sparrowright (Sparowewryghte), Richard Maniour, William of Preston, wright, John Shorte, William of Chilton, John of Plumpton, Lawrence Postel, John Proctor (Proktour), Peter Dryng, John of Bellasis, Walter Barker (Barkear) and the rest of the parishioners of St Oswald's, concerning the custom of live mortuaries and concerning sentences pronounced by Master William of Farnham, official of the bishop of Durham, against John of Sadberge, executor of the testament of Johanna, his late wife, against Agnes, widow and executor of John Goldsmith (Goldesmyth) and against William of Corbridge, executor of the testament of Johanna, his late wife, against all of which appeals were made to the court of York; agreement reached after arbitration, as follows: at the death of any man of the parish, married or single, or of any single woman of the parish, his or her beast or best beast shall be claimed by the prior and convent; at the death of a married woman of the parish whose husband survives her, their best beast shall be claimed; the inhabitants of Framwellgate are expected unless they have beasts elsewhere within the parish also; further agreement that inhabitants of South Street, Crossgate, Allergate, Milburngate, Framwellgate and Sidegate may hear divine service in the chapel of St Margaret, dependent on St Oswald, excepting burials and marriages which must take place at St Oswald's.

Plea by the prior and convent of Durham for the restitution of the tithes due to them within the parish of St Oswald, of which the boundaries are: from where the “Blakeburn” runs into the River Wear, up the “Blakeburn” westwards to the bishop's pond by Kimblesworth, then up to the head of the “Blakeburn” to “Yvesmosse” in the park at Bearpark, then northwards down the syke running from “Yvesmosse” to the river Browney, and upstream along the Browney to the holy well in Middlewood, then from where that spring runs into the river Deerness and along the Deerness to the Wear, upstream along the Wear to where the stream between the fields of Sunderland [Bridge] and Tudhoe enters it, and thence round the lands of the lord of Sunderland [Bridge] to the stream at Croxdale, and round the entire fields of Croxdale and Shincliffe as far as the stream between the fields of Whitwell Grange and Shincliffe, and along that stream down to the march between Sherburn and Old Durham and through the march to “Gillesbrig” at the head of Gilesgate. Within these boundaries the prior and convent claim to have been seised of tithes from the lands of John Bill, Roger Carpenter, Agnes Still and Peter of Bolton, assarted on “le Spitell” and around the crossroads and by the Browney bridge, until they were despoiled thereof twenty years ago, and from all other assarts within these boundaries, of which they were in peaceful possession until the death of Richard of Hoton, prior, but have since been despoiled.

Evidence of the prior concerning toll of the ferry at Sunderland which should be paid to the prior, but is unjustly usurped by the bishop.
1. The vill or borough of Sunderland is part of the vill of Wearmouth; the foundation charter of the borough, issued by Hugh [of le Puiset, bishop of Durham] does not mention the ferry toll.
2. The survey of 1183, called Boldon Book, mentions no ferry toll under Wearmouth.
3. The account of Nicholas Gategang, receiver of the Durham exchequer, for 1337-8, mentions no toll under Wearmouth.
4. The demise of 1348 by Thomas Hatfield, bishop of Durham, to Richard Hedworth and others of the borough of Sunderland, mentions no ferry toll.
5. The account of William of Embleton, receiver of the Durham exchequer, for 1383-4, mentions no toll under Sunderland: the rolls of the Halmote Court should be consulted.
6. The account of William of Embleton, receiver of the Durham exchequer, for 1385-6, mentions no ferry toll under Sunderland.
7. The account of William of Embleton, constable and receiver of the Durham exchequer, for 1385-6, refers to a new rental for the bishop's exchequer: this should be consulted to see whether it refers to a ferry toll.
