The Old University Manuscripts, which are the forerunners of the University Library's Additional Manuscripts, are a miscellaneous collection of volumes and papers acquired by gift and purchase from a variety of sources, not all recorded, at various dates before about 1930. They have been divided into three main categories: Antiquarian Volumes, Law Books, Lecture Notes and Sermons; and arranged in a roughly chronological order within each section. For the most part the original reference numbers, indicating their position in the old University Library shelving sequence, have been retained. The numbers in the H.III and L.V sequences, applied to the volumes of lecture notes and sermons, have however been expanded and re-assigned so that each item now has its own individual number.
The first group of manuscripts, containing material of antiquarian interest, includes a volume of transcripts relating to the rights and privileges of the city of Durham compiled in the late seventeenth century (which has been listed in detail), a poll book for the first Parliamentary election for the county of Durham in 1675, a rate book, and collections of papers belonging to Thomas Bell of Newcastle upon Tyne surveyor and antiquarian, and William and John Fryer surveyors, also of Newcastle upon Tyne.
The Law Books listed here include 11 Precedent and 2 Fine Books. It was a regular task of every newly articled clerk to compile books of precedents, personal reference books, containing examples of all types of legal documents: personal deeds, deeds of property, documents required for court actions and, in Durham, notes on the rules and procedures to be observed in the Palatinate as well as the London Law Courts. They frequently took as their models documents which were recently drafted by their master, and the less discreet among them preserved details such as dates and the names of places and parties. These books are therefore of general historical interest as they may contain the only surviving record of a particular transaction.
The two Fine Books, from the offices of Durham attornies Francis Smales and his son Henry, are records relating to a particular stage in the course of the fictitious legal actions known as Fines and Recoveries, whereby the courts sanctioned a conveyance of property. The books are registers of Fines and Recoveries, kept by the solicitors, with the signatures of parties and the solicitor's notes recording the receipt and delivery of the Indenture parts. Like the Precedent Books they may contain information not available elsewhere.
The final section comprises notes on the lectures of Henry Jenkyns (1794?-1878), the first Professor of Divinity in the University of Durham 1839-1864, sermons and notes on the lectures of his successor Dr. Adam Storey Farrar (1826-1905) Professor of Divinity and Ecclesiastical History 1864-1905, and the sermons of Thomas Sanders Evans (1816-89), Canon of Durham and Professor of Greek 1862-89, with some additional material.
The lectures of Professor Jenkyns, which were delivered ex tempore and never published, were very highly regarded at a time when Divinity was not systematically taught at either Oxford or Cambridge. When therefore four volumes of notes by J. Low Low were offered for sale in 1888 Professor Farrar encouraged their purchase and appealed to other former students to donate their notes also or, at least, to lend them to the Library so that they could be copied. Ten years later one of Professor Farrar's own students presented him with a fair copy of lecture notes and after his death these were given to the Library by his widow, together with exercise books containing some of his sermons. A similar act of homage was performed by J. H. Burn when he transcribed the sermons of Canon Evans out of gratitude for the instruction he received while at Durham although he never took a degree or the Licentiate in Theology. These were given to the University Library by his son R. Burn with other memorabilia about 1925.
A number of other miscellaneous manuscripts which were acquired before 1930 originally had numbers in the same Old University shelving sequence as the manuscripts listed here, but it is believed they were never used for citation purposes, and they have been absorbed into the Additional Manuscripts class. Contains John Hall's accounts as mayor in 1670 and 1674, and copies of documents concerning the rights and privileges of the city of Durham, 12th-17th (but mainly 17th) centuries including: the charters of Bishops Pudsey, Pilkington and Mathew (with translation); charitable bequests; petitions and correspondence concerning Parliamentary representation; grants, leases and court records concerning the toll booth, borough rents, profits from markets and tolls, scavage corn, rights to make freemen, the offices of bailiff and recorder; leases, charter, correspondence and other documents concerning Sunderland iuxta mare; rights over the port, haven and creek of Sunderland from low water mark at the bar of Sunderland to New Bridge, and correspondence concerning beaconage and anchorage; loyal addresses to King James II, the resignation of the Bishop of Rochester as Commissioner for Ecclesiastical Affairs on the decision to proceed against clergy refusing to read the Declaration of Indulgence; letter concerning the city's request for the abolition of the county palatine of Durham 1689, and tax assessments 1689.

24 items relate to the Liddell family of Farnacres and Farnacres Colliery in the parish of Whickham. They include transcripts of deeds and of the registration of the estates of Henry Liddell of the city of Durham at Durham Quarter Sessions 30 April 1717 pursuant to the Act of Parliament obliging Papists to register their names and estates, a pedigree, memoranda and correspondence concerning the unsuccessful attempt to identify the ancient boundaries of Farnacres Chantry lands in 1841, 1676-1895.
The remaining items include monumental inscriptions from the churches or churchyards of Stanhope, Whitburn, Ebchester, Brancepeth, Witton-le-Wear and Jarrow; press cuttings, printed notices, advertisements, prospectuses and particulars of sale, valuations, rentals, correspondence and memoranda relating to a variety of places mostly in the north and east of the county of Durham. Contains some 240 examples in English and Latin of documents used in Durham Palatinate Courts ca.1680-1805, including: Declarations, Narrations, Bills of Complaint, Indictments, Pleas, Fines, Recoveries, Actions in Ejectment, Affidavits, Writs and Warrants; Rules and Orders for procedure in Durham Court of Pleas, Durham Chancery and the County Court, laid down in the late 17th and 18th centuries; tables of fees (pp.250-263, 461-467); and also a copy of Attorneys Practice Epitomized or the Method, Times and Expences of Proceeding in the Courts of King's Bench and Common Pleas . . . . . . by John Worrall and William Reeve, 7th edition 1753 (pp.309-350).
Names of parties and places are mostly preserved, with some indication of date. Of particular note are the documents arising from a dispute between William Joliffe Esq. and Sir Ralph Milbanke concerning the right of presentation to the church of Chester le Street, 1754-1774 (pp.238-246, 446-449); and cases concerning liability to pay poor rate in the townships of Elvet, 1751 (pp.297-302), and Wolsingham, 1758-59 (pp.360-382).
Documents are arranged and indexed according to their form so that items arising from a single case may be dispersed under different headings depending on which stage of the process they represent. The Table of Contents (pp. i-xviii) provides a partial and not always accurate index of forms for pp. 5-268. Some items are indexed under several headings.

Precedent Book containing examples of marriage settlements, declarations of trust, dispositions of lands and monies comprised in trusts, mortgages and other deeds, all but three entries written in the same hand.
Most of the deeds are dated between 1693 and 1698 and, where specified, relate to properties in London and the home counties. A small number concerning properties in Durham or Yorkshire are dated between 1720 and 1726. Names of parties are often reduced to initials and details of premises frequently omitted.

Register of Fines and Recoveries begun by Ralph Lindsay in the office of Francis Smales, 8 October 1800-11 June 1807.
Contains acknowledgements of 23 Fines and 8 Recoveries in respect of premises in the City and County of Durham, including the manors of Winston and Haleigh conveyed by the Earl of Bridgewater to Sir Abraham Hume April 1804 (f.9), the manor of Bradbury conveyed by Richard Wright Esq. to Robert Surtees Esq. February 1806 (f.17v) and a moiety of the manor of Stranton conveyed by William Lynn to Henry Donkin gent. March 1807 (f.20); with memoranda recording the receipt and delivery of indenture parts, initialled “R.L.” until September 1802. Thereafter the signature of Francis Smales occurs frequently and he is named as the Tenant in most of the Recoveries. Ralph Lindsay of Durham was articled to Francis Smales 22 June 1798.

Notes on the lectures of Henry Jenkyns (1795-1878), Professor of Divinity in the University of Durham 1839-1864.
The lectures which Henry Jenkyns gave to students in Divinity over a two year cycle were never written down or published. In 1888 four volumes of notes by J. Low Low were offered for sale and purchased by the University Library. An effort was then made to collect the complete set of lectures by appealing to former students to donate their notes or lend them for copying.
