Contents

The large-scale maps and plans are of properties in the areas of Ryton, Chopwell, Stella and Winlaton, Co. Durham, many surveyed by the Bell family of surveyors (see R. Welford, Men of Mark 'Twixt Tyne and Tweed, I, 244-8). They are dated between 1775 & 1870 with many undated, most are of the early 19th century.
The three volumes are mainly of precedents, proceedings, forms, depositions, fees and items relating to courts c.1569-1733 mainly in the north of England: - Vice Admiralty Courts at Newcastle, York and elsewhere; Durham Consistory Court; the Archbishop of York's spiritual courts; Durham Chancery Court and Courts of Pleas & Assizes; the High Court & Exchequer, Westminster.
The second volume is of depositions 1677-78 in Durham Chancery Court.

Given to the Department of Palaeography & Diplomatic, 3 November 1960 by Sir William Gibson of Newcastle upon Tyne.

Arrangement

The original arrangement of the plans in paper folders has been preserved though the system of continuous numbering here adopted disguises this. Nearly every folder contains some plans of small areas or plans which for other reasons are not worth listing individually, though they might be useful for a detailed study of the area. These have been gathered together at the end of each folder and given one number, e.g. Nos. 13, 23, 38, etc.

These plans concern the areas covered by the rest of the collection. They are large-scale paper plans of small areas, carefully drawn, many lacking place names, which have been supplied in this list. Proprietors' names are common, orientations are rarely given. Some are apparently copies of the local tithe plans with annotations, but tithe plans were often put together from existing plans already in the surveyors' possession, so these similarities could just as well mean that they predate as postdate the tithe plan. The Ryton tithe plan of 1841 was made explicitly from earlier surveys.
Some groupings of plans of different properties on one sheet probably show an individual's holdings. Few of the plans are dated, but there are some watermarks. Some were made about the time of the planning and making of the railway along the Tyne from Newcastle to Hexham, the Ryton section of which is shown complete in the tithe plan of 1841.

A miscellaneous volume of MS. forms, proceedings, mandates, citations, etc., dating from c.1569-1576 (pp.99-118 - mainly High Court rather than local cases for the sixteenth century) and 1650-1706.
Those forms etc. chiefly concern the court of Vice-Admiralty of the County Palatine (or, under the Commonwealth, the county) of Durham but include business of the High Court of Admiralty and of other local Admiralty courts at Newcastle, York and elsewhere, and also certain acts of the Consistory Court of Durham (c.1650-1706) and the spiritual courts of the archbishop of York.
Emsley & Fraser in The Courts of the County Palatine of Durham, pp.68-70 (published by Durham Co. Local Hist. Soc. 1984) in the chapter on the Admiralty court describe Gibson MS.I as a book of precedents compiled by Richard Mathew, on the grounds that it records not only Admiralty cases but also examples of cases in the Durham consistory court (pp.62-63, 147, 188, 437-65) and suits in the Newcastle court of vice-admiralty (pp.174-75, 186-87, 194, 339-41, 389, 425-26), where Mathew also had interests.
The first half of the book (pp.i-iv, 1-204) has been written in volume form; the second half consists of individual papers bound together. Neither half is arranged chronologically.
GBV/Volume II

Calf-bound volume entitled “Durham Court of Chancery” and containing MS. depositions of witnesses in Chancery cases, October 1677 - October 1678.
These were taken by Ralph Tonstall, gentleman, deputy examiner of the Durham Court of Chancery, who signs each heading. Topics mentioned in the depositions include disputes over guilds in Durham (f.14) and Gateshead (f.178), coal-mines (ff.30, 52, 156, 186, 201), Nether Heworth quarries (f.188), tithes at Monkton etc. (f.88), deforestation and fishing rights in Harraton (f.56), lands in Rowley which were alleged to be freehold (f.110), competing mills in Wolsingham (f.146) and the activities of a financial agent (ff.74, 96), as well as cases over debts, dowries and land boundaries. Entries include the age, occupation, address and signature of deponents and at the front of the volume there is an index of names of complainants and defendants.
Loose in the volume is a letter from Tho[mas] Hugo, [rector of West Hackney, Stoke Newington] to Mr. M. Mackey Jun[io]r, written at Ilfracombe, 18 October 1876. Thomas Hugo, 1820-1876, was the author of three works on the wood-engravers, Thomas and John Bewick and was well known for his collection of Bewick material. See Dictionary of National Biography . This concerns the wood-blocks and the identification of some of the engravings of Bewick [?Thomas Bewick, wood-engraver, 1753-1828 or his brother, John Bewick, wood-engraver, 1760-1795].

Stuck on to the inside front cover are the book-plate of Edward Arthur White, F.S.A. and a printed sale description of the volume. Inside the front cover there is also a note: "Lot 313. Vellum-bound volume, drawn up c. mid-eighteenth century, entitled “Old Pleadings & Rules of Court Ra. Robson”, and containing (ff. 2 et seq. and f.51) examples of legal documents issued by the Durham courts of Chancery, Pleas and Assizes, with records of some pleas in these courts, temp. George I and George II and n.d., and (ff.14, 52) pleas before the Exchequer Barons at Westminster, 1729-1733. The volume also includes lists of fees and orders of episcopal courts and officials.
